NYS Court Officer Applying Facts to Situations

This ability gives you a regulation, policy, or procedure and the facts of a situation, then asks you to determine what the supplied rule requires.

The rule is contained in the question

OCA's description says all information needed to answer is provided. The task is not a recall test for statutes or courthouse policy. It is a controlled application problem: identify the conditions in the stated rule, match the facts to those conditions, and follow the stated exception or sequence exactly.

A reliable way to work through an item

First rewrite the rule mentally as a short if-then statement. Next test each fact against each condition, paying special attention to words such as only, unless, before, and except. Finally, reject any choice that adds an unstated fact or substitutes what might happen in a real courthouse for what the printed rule says.

Because the examination is an aptitude test, outside legal knowledge can distract as easily as it can help. The governing material for the item is the material OCA places in front of you.
